The Decision was Issued on June 28, 2020 by the Intellectual Property Division of the Suzhou Intermediate People’s Court; Enforcing Oracle’s Intellectual Property Rights Against an Infringing Chinese Factory

METAIRE, LA, USA, July 9, 2020 – Oracle Lighting (www.oraclelights.com), an innovator in high quality LED lighting solutions for the automotive industry, is proud to announce that it has successfully defended its intellectual property rights by recently winning its legal battle against a Chinese-based manufacturer of imitation products.

“Shortly after we unveiled our Vector™ LED Grill System at a trade show in 2017, Chinese knockoffs began appearing,” explained Justin Hartenstein, Director of Product Development at Oracle Lighting. “After nearly a year of work designing and developing this product, it was honestly heartbreaking to find knockoff products pop up online. I had seen this happen before to other manufacturers in our industry and decided that we were not going to stand for this blatant design theft. We worked with our IP attorney, Jeffrey Banyas of Edwin A. Sisson, Attorney at Law, LLC, to develop and execute a strategy to take action against the overseas knockoff producers. I knew it would not be easy but I had no idea where this journey would take us.”

The decision was issued on June 28, 2020 by the Intellectual Property Division of the Suzhou Intermediate People’s Court (Case No. [2019] Suzhou 05 Intellectual Property First Instance No.580). The court found that the defendant’s products fall into the scope of protection of Oracle Lighting’s Chinese Design Patent Registration No. ZL201830136860.7, and thus infringes the patent.

The court’s decision includes an order for the defendant to immediately cease infringing upon Oracle Lighting’s patent. The court also ordered the defendant pay significant monetary damages to Oracle Lighting and ordered that the defendant pay certain court costs associated with the litigation. In doing so, the court also rejected the defendant’s arguments that they had come up with the design for this particular grill prior to Oracle Lighting filing its design patent application.

“In order for us to file litigation against the infringing company, the Chinese court explained that we had to first complete a ‘notarized purchase’, which basically translates to us having to conduct our own sting operation,” Hartenstein continued. “Our attorney assisted us in hiring private investigators overseas who, after months of investigation, used a cover story to gain access to the factory and, with hidden cameras, obtained evidence of the counterfeit parts. The entire operation had to be covert because these factories producing knockoff goods are often designed to be packed up and moved overnight, making them hard to pin down. Once our legal team in China presented this evidence to the judge, the court issued a demand to the factory to shut down production and the nearly two-year-long litigation process began. This was a massive undertaking for our company but I pursued this in the hope that it provides insight for other small businesses trying to protect their intellectual property rights overseas. It was not easy but these results demonstrate that even overseas counterfeiters can be held accountable. Oracle Lighting takes our intellectual property rights very seriously and we are willing to do whatever it takes to prevent the blatant theft of our patented designs.”

Banyas explained that Oracle Lighting asked his firm to develop and implement a plan to protect its products against overseas knockoffs and counterfeits. “This was no easy task as those who deal in illegal products often take extensive measures to insulate themselves from liability and accountability,” he explained. “Through our firms’ extensive network of private investigators and international law firms, we identified the factory making the knockoff products and obtained all of the evidence we needed to enforce Oracle Lighting’s Intellectual Property Rights. We thank the Suzhou Intermediate People’s Court for giving us a fair day in court and we hope that this decision serves as a strong example to other American companies that they can enforce their Intellectual Property Rights in China, and they do not simply have to accept lost market share to Chinese knockoffs and counterfeit products as an inevitable cost of doing business. I applaud the folks at Oracle Lighting for bucking that trend, and I am proud to have spearheaded the efforts that lead to these successful results.”

(METAIRIE, La) -- A Metairie-based manufacturer was awarded a 2021 Louisiana Lantern Award Wednesday evening. Oracle Lighting, which creates LED solutions for consumers in the automotive, marine, and powersports markets, received the prestigious award during a special reception at the Hilton Baton Rouge Capitol Center. The company is one of eight manufacturers across the state to be recognized this year.

The Louisiana Lantern Awards provide an opportunity for the State to celebrate manufacturers from across Louisiana. The winning company for each district displays a contribution to the Louisiana economy and their local business communities through employee growth, increased revenue, facility expansion and community engagement. The Jefferson Parish Economic Development Commission (JEDCO) nominated Oracle Lighting for the special distinction this year. The lighting manufacturer was selected from the Greater New Orleans region to receive the coveted award.

Born from humble beginnings in a Metairie garage, Oracle Lighting has grown into a global leader in the automotive lighting industry. The company was founded by Justin Hartenstein when he was just 18 years old. The new Ford Bronco is one of the most popular vehicles on the road and Oracle’s Flush Tail Lights (Part# 5892-504) are a big improvement. These are compatible with both the with factory halogen tail lights and with LED tail lights (will require ForScan flash) for all Broncos model years 2021-2023 (except Raptor) and have a MSRP of $449.95

The innovative modular design of Oracle’s LED tail lights for the Ford Super Duty (Part# 5896-504) features a unique animated turn signal sequence and adapters to fit both Halogen and LED model tail lights. Compatible with F250, F350, and F450 model years 2017-2022 and have an anticipated MSRP of $495.95.

Oracle Lighting’s optional multi-layer designs feature a contrasting center layer, or “accent color” layer, to help the letters have a visual pop even during the day when the lights are off. These layers are held together both with marine-grade 5200 adhesive and mechanically with hardware. The system features selectable amber or white clearance lights, and you can choose to connect these lights to an aux switch, parking lights, DRL, or simply have them disconnected if you prefer not to use the additional clearance light feature.

Now shipping with an MSRP of $38.75 (per letter), these vibrant letters are available in a matte white or matte black surface finish with either white LED or amber LED.

“These individual LED illuminated letters are the perfect way to make your own marquee-style glowing vehicle badge for your vehicle,” explained Justin Hartenstein, Oracle Lighting director of development. “When turned on, the letters emit a soft edge-lit glow to make your custom badge stand out. Even when off, the sleek design of the letter housings gives a customized high-end appearance.”

The LED lighting has a low draw…less than 0.1 Amp per letter with an overall size of approximately 3.75in. wide x 1.4in. tall x 0.5in thick. Installation is easy with the VHB double-stick adhesive. Simply wire the letters to a 12V source such as parking lights, ignition fuse, or a separate toggle switch. Please note that a hole may be required to route the wire, and each vehicle’s needs will be different. Oracle Lighting recommends using the company’s VHB Primer (Oracle p/n 2082-504) to get the best bond with the mounting surface.
